General Provisions

The data management of https://pohuy.com.ua (hereinafter referred to as the “Site”) is carried out by sole proprietor Makhonina Valentyna Serhiivna (TIN 3155002728), who is registered and operates in accordance with the requirements of Ukrainian legislation (hereinafter referred to as the “Company”). The Company treats the confidential (personal) information of all persons who visit the Site, as well as those who use the services provided by the Site, with great respect; therefore, the Company strives to protect the confidentiality of personal data (information or a set of information about an individual who is identified or can be specifically identified), thereby creating and ensuring the most comfortable conditions for using the Site’s services for each user.

This Privacy and Personal Data Protection Policy (hereinafter referred to as the “Policy”) establishes the procedure for the Company’s processing of personal data, the types of personal data collected, the purposes of using such personal data, the Company’s interaction with third parties, security measures to protect personal data, conditions for accessing personal data, as well as contact information for users to obtain access, make changes, block or delete their personal data and address any questions that may arise regarding personal data protection practices.

Collection and Use of Personal Data

The owner and controller of the personal data of Site users is sole proprietor Makhonina Valentyna Serhiivna.

When a user uses the Site’s services, the Company processes user data, namely: – data provided by the user both when filling out registration forms and in the process of using services; – cookie files; – IP address; – internet browser parameters and settings (User-agent). The Company collects only those personal data (for example, your first and last name, login and password, email address, contact phone number, date of birth, gender, etc.) that are consciously and voluntarily provided by you as a personal data subject for the purpose of using the Site’s services, which, in accordance with legal requirements, constitutes the personal data subject’s consent to the processing of their personal data in accordance with the purpose of their processing as formulated in this Policy.

During visits to the Site, all system logins are recorded. Other information regarding user traffic is not processed or stored.

Please note: The Company limits itself to collecting the minimum amount of information necessary to fulfill the personal data subject’s request. In any case where non-mandatory information is requested, the user will be notified at the time such information is collected. The Company does not collect any information for which legislation establishes certain processing requirements, such as information about racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties and trade unions, criminal convictions or sentences, as well as data on health, sexual life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”). The Company collects data on Site visit statistics. The information may include connection information, traffic, user browser, as well as the date, time, duration of work on the Internet and presence on the Site.

Use of Cookies

A cookie is a text file or files containing a small amount of information that are sent to a web browser and stored on the user’s device. Such devices may include a computer, mobile phone, or other device through which the user visits a website. Cookies can be permanent (they are called persistent cookies) and stored on the computer until the user deletes them, or temporary (such cookies are called session cookies), meaning they are stored only until the browser is closed. The Site is not intended for minor users. The Company takes security issues very seriously, especially regarding minors, and therefore, for its part, the Company asks parents to explain to their children the issues of Internet safety, their specific purpose and the need to use certain Site services.

The Company uses generally accepted standards of technological and operational protection of information and personal data from loss, misuse, alteration or destruction. However, despite all efforts, the Company cannot guarantee absolute protection from any threats that arise beyond the Company’s control.

The Company ensures the application of all relevant confidentiality obligations, as well as technical and organizational security measures to prevent unauthorized or unlawful disclosure or processing of such information and data, their accidental loss, destruction or damage.

The Company provides access to information and personal data only to authorized employees who have agreed to ensure the confidentiality of such information and data in accordance with the Company’s requirements. Distribution of personal data without the consent of the personal data subject or their authorized person is permitted in cases determined by law, and only (if necessary) in the interests of national security, economic welfare and human rights.

Rights of the Personal Data Subject

The Company informs you about your rights as a personal data subject, which are regulated by the Law of Ukraine “On Personal Data Protection”, namely:

1) to know about the sources of collection, location of their personal data, the purpose of their processing, the location or place of residence (stay) of the owner or controller of personal data, or to provide appropriate instructions regarding obtaining this information to persons authorized by them, except in cases established by law;

2) to receive information about the conditions for granting access to personal data, including information about third parties to whom personal data is transferred;

3) to access their personal data;

4) to receive, no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, a response as to whether personal data is being processed, as well as to receive the content of such personal data;

5) to submit a reasoned demand to the personal data owner objecting to the processing of their personal data;

6) to submit a reasoned demand to change or destroy their personal data by any owner and controller of personal data if this data is processed unlawfully or is inaccurate;

7) to protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, non-provision or untimely provision, as well as to protection from the provision of information that is inaccurate or defames the honor, dignity and business reputation of an individual;

8) to file complaints about the processing of their personal data with the Commissioner of the Verkhovna Rada of Ukraine for Human Rights or with the court;

9) to apply legal remedies in case of violation of personal data protection legislation;

10) to make reservations regarding the restriction of the right to process their personal data when giving consent;

11) to withdraw consent to the processing of personal data;

12) to know the mechanism of automatic processing of personal data;

13) to protection from an automated decision that has legal consequences.
